MP Msukuma faces court action over Sh 784.5mil NBC loan default

Dar es Salaam. Outspoken Geita Rural MP, Joseph Msukuma, may find himself in trouble allegedly for defaulting a Sh784.5 million loan he took from the National Bank of Commerce (NBC) bank nine years ago.

A person who mortgaged his mansion located at Mbezi, Dar es Salaam, to guarantee the MP to secure the loan, Martin Nandi, has instructed his lawyers to inform the MP of his intention to take legal action against him to save his property.

The NBC has already written a notice of default to notify Mr Nandi Msukuma’s default of the loan which he guaranteed and converted under mortgage deed of 22, June 2018.

“Be further notified that in the event that the borrower (Joseph Msukuma) does not rectify the default within 60 days from receipt of this notice, NBC Limited may exercise its right to sell the mortgaged property…,” read part of the notice directed to Mr Nandi on March 21, 2018.

Mr Msukuma declined to comment on the issue, saying he couldn’t comment on the matter that has already landed in court for consideration.

“What should I comment while the matter is pending in court? He asked, saying he was told the complainant has failed a case against him in the High Court.

Mr Nandi and his lawyer Rabin Mafuru have separately told The Citizen that they are yet to file any case against the MP but insisted they were finalizing consultation before dragging the MP to court.

The MP has declined further comment even after The Citizen sent him a text message to inform him there was no court case against him over the mater.

Through Raymaxx Attorney, Mr Nandi want the legislator to settle the debt the debt in seven day or face court action.

According to the demand notice, Msukuma approached Mr Nandi on 16^th, June 2018 with the intention of engaging him in a mobile phone business venture and promised him directorship of the company and other fringe benefits.

“In reliance to this our client submitted to you his title deed. However you have continued to use the title deed fraudulently and without consent from our client to renew you loan facility with NBC contrary to law and order,” read part of the demand notice.

The lawyer gave the legislator seven days to settle the debt without delay failure of which will merit their client to institute civil and criminal proceedings against him to recover the amount and damages.

The lawyers accuse the MP of avoiding the guarantor and bank by maneuvering for the past ten year.

NBC’s senior official William Kallaghe said he has no knowledge of the dispute and promised to work on it.
