VIDEO: Court upholds Speaker’s decision on Arumeru East MP Joshua Nassari

  • The High Court in Dodoma has concurred with decision made by Speaker of the National Assembly Job Ndugai to unseat former Arumeru East MP Joshua Nassari after missing three Bunge sessions.

Dodoma.  High Court Judge in Dodoma Latifa Mansour on Friday, March 29, 2019 spent 44 minutes reading the ruling that okayed National Assembly Speaker Job Ndugai’s decision to unseat former Arumeru East MP Joshua Nasari (Chadema).

Mr Ndugai wrote to the National Electoral Commission (NEC) informing the electoral body that the constituency was vacant after Mr Nassari had missed three sessions.

Reading the decision, Ms Mansour said the Parliamentary Regulation 5 (4) required Mr Nasari to file complaints to Clerk of the National Assembly instead of taking the matter to the court.

Also regulation 146 (2) clearly states that legislators cease to be lawmakers after missing three consecutive parliamentary meetings.

Outside the court, Mr Nassari told The Citizen that there was no quality gold that can avoid fire, noting that after sustaining gun attack that killed dogs at his home, sustained plane crash he wasn’t intimidated at all by the ruling.
