High Court to rule in Kinana, Msigwa poaching suit today

Dar es Salaam. The High Court and the Kisutu Resident Magistrate’s Court are expected to deliver judgments on two separate cases today, including one concerning the abuse of office facing two former Tanzania Building Agency (TBA) officials.

The other is a defamation suit lodged by CCM secretary general Abdulrahman Kinana at the High Court against Iringa Urban MP, the Rev Peter Msigwa. Mr Kinana is demanding payment of Sh350 million in damages from the opposition lawmaker for allegedly calling him a poacher.

Judge Zainabu Mruke is expected to deliver the ruling after going through the submissions presented by the parties on some grounds of preliminary objections raised by the MP from the main opposition party, Chadema, seeking dismissal of the suit in question.

In the other case at the Kisutu Resident Magistrate’s Court, presiding magistrate Sundi Fimbo is expected to deliver judgment on the case against former TBA chief executive officer Makumba Togolai Kimweri and former principal architect Richard John Maliyaga with the same institution for allegedly abusing their positions. They are accused of authorising construction of a commercial, high rise structure near the State House in Dar es Salaam against the law.

In the TBA case, the accused have already concluded their defence testimony, and so has the prosecution side.

According to prosecution, the duo authorised Royalle Orchard Inn Limited to construct a commercial building on plots number 45 and 46 located on Chimara Street, Ilala Municipality in Dar es Salaam contrary to the Urban Planning Act, 2007.

In the High Court case, Rev Msigwa, the defendant, is alleged to have accused Mr Kinana of being a poacher and dealer in illegal ivory trade.

Through his advocate, Mr Eric Ng’maryo, the CCM boss is also requesting the court to order the opposition legislator to pay other damages to be assessed by the court, interest at the court rate from the date of delivery of judgment to the payment of a decretal amount in full and costs of the suit.
