Former Simiyu RC charged in court for allegedly sodomising university student

Mwanza. Former Simiyu Regional Commissioner Yahya Nawanda has been arraigned on charges of sodomizing a university student from Mwanza.

Nawanda appeared before the Chief Resident Magistrate for the Mwanza Regional Court, Erick Marley, facing charges of sodomizing 21-year-old student Tumsime Ngemela from a local university.

He arrived at the courthouse in a private Land Cruiser, accompanied by Mwanza Regional Crimes Officer (RCO) Yesaya Sudi and other armed and unarmed police officers.

The charge under criminal case number 1883/2024 was read by prosecutor Ms Magreth Mwaseba, assisted by Martha Mtiti.

Ms. Mwaseba informed the court that the accused allegedly committed the offense on June 2, 2024, in the parking lot of Rock City Mall, Ilemela district, contrary to section 154 (1)(a) of the Penal Code, Chapter 16.

"You, Yahya Nawanda, a resident of Nyamata in Bariadi district, Simiyu region, are charged with sexually assaulting Tumsime Ngemela on June 2, 2024," stated Ms. Mwaseba.

After the charge was read, Ms. Mwaseba indicated that investigations were complete and requested a date for the commencement of the public hearing.

In response, Dr. Yahya Nawanda, represented by his lawyer Mr. Constantine Mutalemwa, pleaded not guilty to the allegations and applied for bail, citing the bailable nature of the offense.

Upon denying the charges, Magistrate Marley granted bail to the defendant under conditions that included two sureties—one from the public sector and another from the private sector—who each signed a bond secured by property valued at no less than Sh5 million.

Magistrate Marley cautioned that the bail would be forfeited if the defendant violated any of the conditions, including failing to appear in court.

After meeting the bail conditions, Nawanda was released, and Magistrate Marley adjourned the case until July 16, 2024, for the preliminary hearing.
